These terms govern the sale of products available on efori.it.

02 — Scope

Scope of application

These terms apply to orders placed through the EFORI online store.

By placing an order, the customer confirms that they have reviewed the information relating to the products, prices, payment methods, delivery, returns and these terms.

Where the purchaser acts as a consumer, all mandatory rights granted by Italian, European and, where relevant, the law of the customer's country of residence remain applicable.

03 — Customer

Requirements for making a purchase

Anyone placing an order must have the legal capacity required to enter into the contract under the applicable law or act with any assistance or representation required by law.

The customer is responsible for the accuracy of the information entered during the purchase process.

In particular, complete and accurate contact, payment, billing and delivery information must be provided.

04 — Products

Products and characteristics

EFORI sells clothing and the other products available in its online catalogue.

The essential characteristics of each product, including where applicable size, colour, composition, price and availability, are shown on the relevant product page.

Images and colours

EFORI aims to represent products as accurately as possible.

However, the actual appearance of colours, shades and details may vary depending on the device, screen and related settings used.

05 — Availability

Product availability

Products may be purchased subject to the availability indicated on the website.

In exceptional circumstances, a product may appear available at the time of the order but later prove unavailable, for example because of an inventory or technical update error.

In that case, EFORI informs the customer and, where necessary, refunds any amounts already paid for the unavailable product.

Before purchase

Price, shipping and payment method are shown before the order is confirmed.

Before completing the purchase, the customer can review the selected products, quantities, any discounts, delivery method, shipping cost, payment method and total order amount.

06 — Order

Purchase procedure

To make a purchase, the customer selects the desired products, adds them to the cart and completes the checkout process.

Before final confirmation, the customer can review:

  • selected products;
  • quantities;
  • sizes and variants;
  • prices;
  • any promotions applied;
  • delivery address;
  • delivery or collection method;
  • shipping costs;
  • payment method;
  • total order amount.

After the order is submitted, EFORI sends a confirmation to the email address provided by the customer.

07 — Contract

Order confirmation and contract formation

Submitting the order constitutes the customer's request to purchase the selected products under the conditions shown during checkout.

The contract is considered concluded when the order is confirmed by EFORI in accordance with the procedure used by the website.

Authorisation or reservation of a payment does not prevent EFORI from taking action on the order where there is a legitimate reason preventing fulfilment.

08 — Refusal

Orders that cannot be fulfilled

EFORI may refuse or cancel an order where there is an objective and legitimate reason, for example:

  • product unavailability;
  • payment not authorised;
  • reasonable suspicion of fraud;
  • essential information that is incomplete or incorrect;
  • impossibility of delivery;
  • an obvious error in the price or order information.

Where a payment has already been actually collected, the amount due is returned using the appropriate method.

09 — Prices

Prices and costs

The price applicable to a product is the price shown during the purchase process at the time the order is placed.

Prices intended for consumers are shown inclusive of applicable taxes, where due.

Any shipping costs or other applicable charges are shown separately before the purchase is finally confirmed.

For international shipments, the cost may vary depending on the destination and is shown directly during checkout.

10 — Promotions

Promotions and discount codes

EFORI may periodically offer promotions, special offers or discount codes.

Individual promotions may be subject to specific conditions such as:

  • validity period;
  • eligible products or collections;
  • minimum order amount;
  • maximum number of uses;
  • use limited per customer;
  • possible incompatibility with other promotions.

Promotional codes may not be valid during certain campaigns or promotional periods where this is stated in the terms of the initiative.

11 — Payments

Payment methods

EFORI offers the payment methods displayed during checkout.

Payment Shopify Payments
Payment PayPal
Payment Klarna

Through Shopify Payments, cards and other payment methods actually enabled in the store may be accepted.

The availability of specific payment options offered by Klarna and any approval of the related service depend on checks carried out directly by the provider.

Not available

EFORI does not currently accept bank transfer or cash on delivery.

12 — Shipping

Shipping and delivery

Orders are generally prepared within 2–5 business days, excluding weekends and public holidays.

The preparation time is separate from the time required by the carrier to complete delivery.

Italy

€8.90

Standard domestic shipping. Shipping is free for orders of €100 or more.

International

Variable rate

The cost varies depending on the destination and is shown during checkout.

EFORI ships to Italy and to European and non-European destinations enabled at checkout.

Unless a different deadline has been agreed, delivery takes place without undue delay and in any event within the period required by applicable law.

13 — International

International shipping and customs

For shipments to countries outside the European Union, customs procedures, duties, import taxes or other local charges may apply.

Where such amounts are not already included or collected during checkout, they may be requested from the recipient by the authorities, carrier or customs clearance provider.

Any time required for customs procedures may affect the overall delivery time.

14 — Collection

Warehouse collection

Where available for the order, the customer may select the warehouse collection option directly during checkout.

Collection is managed as a dedicated delivery method and not through a discount code used to artificially remove shipping costs.

After the order is placed, the customer receives the information needed regarding availability, location and collection arrangements.

The customer should not arrive for collection before receiving confirmation that the order is ready.

15 — Risk

Transfer of risk

For purchases made by consumers, the risk of loss or damage to the product remains with the seller until the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the product.

This is without prejudice to specific cases provided by law, including where the consumer independently appoints a carrier not proposed by the seller.

16 — Withdrawal

Right of withdrawal

For online purchases, consumers may notify their decision to withdraw within 14 days from delivery, subject to the conditions described in the Returns and Refunds Policy.

EFORI also provides the Shopify Returns and Cancellations Self-Service system for managing requests.

For orders sent to non-EU countries, EFORI applies the commercial return window stated in its policy, without prejudice to any mandatory rights granted by the applicable legislation.

17 — Warranty

Statutory guarantee of conformity

The right of withdrawal is separate from the statutory guarantee of conformity.

Goods sold to consumers in the European Union are covered by a minimum statutory protection period of two years from delivery.

If a product is defective, does not function properly or does not correspond to the agreed characteristics, the consumer may benefit from the remedies provided by applicable law.

Depending on the circumstances, these remedies may include repair or replacement at no cost and, where the relevant conditions are met, a price reduction or termination of the contract.

EU statutory guarantee

Rights arising from the statutory guarantee exist independently of the right of withdrawal and any additional commercial warranties.

18 — Intellectual property

Intellectual property

The EFORI trademark, logos, photographs, images, videos, graphics, text, design and other original content on the website may be protected by intellectual and industrial property laws.

Such content may not be reproduced, distributed, modified, published or used commercially without authorisation, except where permitted by applicable law.

Trademarks and content belonging to third parties remain the property of their respective owners.

19 — Use

Use of the website

The website must be used lawfully and with respect for the rights of EFORI, other users and third parties.

It is not permitted to:

  • use the website for unlawful purposes;
  • infringe intellectual property rights or other third-party rights;
  • introduce viruses, malware or other harmful code;
  • interfere with the security or proper functioning of the website;
  • attempt to access systems, accounts or data without authorisation;
  • use EFORI content for unauthorised commercial purposes.
20 — Third parties

Third-party services and links

Certain website features are provided through services or infrastructure operated by third parties.

These may include, depending on the function used:

  • Shopify;
  • payment providers;
  • logistics services and couriers;
  • other technical providers necessary for the operation of the store.

Where the customer uses a service independently operated by a third party, the relevant terms and notices may also apply.

The website may also contain links to external websites. EFORI does not necessarily control the content or operation of websites independently managed by third parties.

21 — Service

Website operation

EFORI takes reasonable measures to keep the website available, up to date and functioning.

Temporary interruptions may nevertheless occur due, for example, to maintenance, technical updates, provider issues or circumstances beyond EFORI's reasonable control.

No provision of these terms limits any mandatory rights granted to consumers.

22 — Liability

Liability

EFORI is responsible for performing its obligations within the limits provided by applicable law.

These terms do not exclude or limit any liability that cannot legally be excluded or limited.

In particular, nothing in these terms should be interpreted as a waiver of mandatory consumer rights.

23 — External events

Circumstances beyond reasonable control

Exceptional events beyond the reasonable control of the parties may temporarily affect the performance of certain obligations, for example the availability of services or transport times.

Such circumstances are assessed on a case-by-case basis and do not result in the loss of mandatory consumer rights under applicable law.

24 — Complaints

Complaints and support

If there is an issue relating to an order, payment, delivery, return or product, the customer may contact EFORI.

Where available, the customer is advised to provide the order number and the information needed to identify the issue quickly.

Any alternative dispute resolution mechanisms provided by applicable law remain available.

25 — Governing law

Governing law and jurisdiction

These terms are governed by Italian law.

If the customer is a consumer residing in another country, the application of Italian law does not deprive the customer of any mandatory protections guaranteed by the law applicable in their country of residence.

For disputes involving consumers, the mandatory territorial jurisdiction rules protecting consumers remain applicable.

26 — Changes

Changes to these terms

EFORI may update these terms to reflect legal, technical, commercial or organisational changes.

The version applicable to a purchase is the version relevant at the time the related contract is concluded.

Subsequent changes do not retroactively deprive the customer of rights already acquired in relation to previous orders.
